1. Agreement to Terms

By accessing or using asQkme ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Description of Service

asQkme is a social polling and matching platform that allows users to:

• Create and participate in polls (text and image-based)
• Vote on polls created by other users
• Comment on polls and engage in discussions
• Match with other users based on poll answers and preferences
• Connect with matched users through friend requests
• Communicate with friends through direct messaging
• View user profiles and activity

3. User Accounts

3.1 Age Requirement

You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

We reserve the right to verify your age and may require proof of age at any time. If we discover that you are under 13 or have misrepresented your age, we will immediately terminate your account and delete your information in accordance with applicable law.

3.2 Account Creation

• You must provide accurate, current, and complete information during registration, including a valid email address.
• During sign up, we collect your email address, which is required for account creation, authentication, and service-related communications.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.

3.3 Email Communications

By creating an account, you consent to receive email communications from us related to the functioning of the website and your account. These emails may include:

• Account verification and authentication emails
• Password reset and security notifications
• Service updates and important announcements
• Notifications about matches, friend requests, messages, and other activity
• Technical and administrative communications

You can opt out of non-essential email communications at any time through your account settings or by using the unsubscribe link provided in our emails. However, you may not opt out of essential service-related emails (such as account security notifications, password resets, or important service updates) as these are necessary for the proper functioning of your account and the Service.

3.4 Account Security

• You must immediately notify us of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree not to:

• Post, upload, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Post, upload, or transmit any explicit, pornographic, sexually explicit, or adult content of any nature
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Post content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights
• Upload viruses, malware, or any other malicious code
• Spam, harass, or abuse other users
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Collect or harvest information about other users without their consent
• Use the Service for any commercial purpose without our prior written consent
• Violate any applicable local, state, national, or international law

5. User Content

5.1 Content Ownership

You retain ownership of any content you post, upload, or create on the Service ("User Content"). However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content for the purpose of operating and providing the Service.

5.2 Content Responsibility

• You are solely responsible for your User Content and the consequences of posting it.
• You represent and warrant that you own or have the necessary rights to post your User Content.
• You represent and warrant that your User Content does not violate any third-party rights.
• You are solely responsible for ensuring that your User Content does not contain explicit, pornographic, sexually explicit, or adult content of any nature.

5.3 Explicit Content Prohibition and Disclaimer

Explicit content, including but not limited to pornographic, sexually explicit, or adult content of any nature, is strictly prohibited on the Service. Users are expressly forbidden from posting, uploading, or transmitting any such content.

Notwithstanding the foregoing, asQkme is not responsible for any explicit, pornographic, sexually explicit, or adult content that users may post, upload, or transmit on the Service. While we provide reporting mechanisms that allow users to report inappropriate content so that it may be reviewed and removed, we do not monitor all content in real-time and cannot guarantee that all prohibited content will be immediately identified or removed.

By using the Service, you acknowledge and agree that:

• asQkme is not responsible for any explicit or inappropriate content posted by users
• You may encounter content that violates these Terms, including explicit content
• You should use the reporting features available on the Service to report any inappropriate content
• asQkme will make reasonable efforts to review and remove reported content that violates these Terms, but makes no guarantees regarding the timing or completeness of such removal

5.4 Content Moderation

We reserve the right to review, edit, or remove any User Content at our sole discretion. We may remove content that violates these Terms or is otherwise objectionable, without prior notice. While we provide reporting mechanisms for users to report inappropriate content, we do not guarantee that all prohibited content will be immediately identified or removed, and we are not responsible for any content posted by users prior to its removal.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by asQkme and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

7. Matching and Friend Features

• Matches are generated based on poll answers and user preferences using our proprietary algorithm.
• We do not guarantee matches or the quality of matches.
• You are responsible for your interactions with other users, including matched users and friends.
• We are not responsible for the conduct of any user, whether online or offline.
• You should exercise caution and good judgment when interacting with other users.

8. Prohibited Uses

You may not use the Service:

• In any way that violates any applicable law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us or using account deletion features.

All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of correctness, accuracy, reliability, or otherwise.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ASQKME, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless asQkme and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which asQkme operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements.
